Terms for use of Infoweb.ee database.
1 TERMS
1.1 Infoweb.ee – service provider which consists of Infoweb Teenused OÜ (registration
number:
10838419, aadress Mustamäe tee 60, Tallinn, Republic of Estonia).
1.4 Database – Infoweb.ee's database on the webpages www.infoweb.ee.
1.3 User – any individual who has agreed to these conditions and has registered in the database.
1.4 User information – any data of the User entered by the User into the database, including the data entered in the registration form and the CV form of the database.
1.5 Receiver of information – any legal person or individual who uses the database for search for services or business contacts.
1.6 Parties to the contract – Infoweb.ee and the User.
1.7 Services – any services of Infoweb.ee targeted towards advertising, etc., the User undertakes to pay a fee to Infoweb.ee according to the rates and conditions indicated in the description of the respective Service.
1.8 Access data – a username and password selected by the User at registration as a User or changed in the database at some later time by the User.
1.9 Portal – environment found on the web address www.infoweb.ee which has been created and is managed by Infoweb.ee .
2 USER’S RIGHTS AND OBLIGATIONS
2.1 After having filled in the registration form and agreed to these conditions, the User will get access to the database for using the services via access data.
2.2 The User is obligated to keep access data confidential and not to disclose the data to any third parties. The User shall be fully liable for the use of access data.
2.3 If the User has forgotten his/her access data or suspects that the access data have become available to third parties, the User shall change his/her access data immediately via his/her user account in the database, or give notice of what has happened to Infoweb.ee via e-mail or telephone, after which Infoweb.ee will change the access data for the User.
2.4 The User shall enter into the database only true and precise user information. The User shall be liable for any damage caused to Infoweb.ee or third parties as a consequence of any untrue, imprecise or incomplete user information submitted by the User.
2.5 All the rights to the database belong to Infoweb.ee. The User will not acquire any rights to the database or parts thereof by way of using the database and the services. The User is not allowed to make other excerpts from or copies of the database or use the database in any other way whatsoever, or otherwise cause damage to or disrupt the functioning of the database. Through the use of the database in any way (incl. for the purposes of using a service), the User shall not acquire any copyrights to the software needed to run the database.
2.6 The User is entitled to supplement, amend and replace any user information entered into the database by the User. To delete his/her user account the User must send a respective request to the e-mail address teenindus@infoweb.ee.
2.7 BY AGREEING TO THESE CONDITIONS THE USER CONFIRMS THAT HE HAS GIVEN HIS/HER CONSENT
TO
INFOWEB.EE FOR PROCESSING THE PERSONAL DATA OF THE USER SUBMITTED BY THE USER AT REGISTRATION WITH THE
PORTAL OR
ENTERED BY THE USER INTO THE DATABASE IN ACCORDANCE WITH AND TO THE EXTENT PROVIDED FOR IN CLAUSES 3.2,
3.3, 3.6 AND
3.9 BELOW.
3 INFOWEB.EE’S RIGHTS AND OBLIGATIONS
3.1 Infoweb.ee shall enable the User to use the services in accordance with the provisions of these conditions and the portal as of the moment of registration by the User with the portal.
3.2 Infoweb.ee will process (incl. collect, store, save, organise, distribute, compile, use, delete, make available to receivers of information, etc.) the User’s personal data submitted at registration with the portal and entered into the database by the User for the purposes of rendering services to the User. Infoweb.ee shall process personal data of the User itself, and forward such data to receivers of information for the purposes of implementing contracts concluded with such receivers.
3.3 If Infoweb.ee has grounds to suspect that the personal data of the User entered into the database are untrue or do not comply with generally accepted moral standards, Infoweb.ee has the right to delete the entered data from the database.
3.4 Infoweb.ee is neither an authorised representative nor agent of any receiver of information, and therefore, Infoweb.ee shall not be liable for any damage that may be caused to the User.
3.5 Infoweb.ee does not give any guarantees that the User will find a business contact via the portal, and does not undertake to communicate for this purpose with any persons who need services.
3.6 Infoweb.ee takes no responsibility for any illegal or unsanctioned use of the User’s personal data that are made available to a receiver of information, neither for the confidentiality of such information if the confidentiality must be ensured by the receiver of information.
3.7 Infoweb.ee has the right to give notice to the User of the services, possibilities and news of Infoweb.ee and its business partners via the e-mail address entered by the User at registration with the portal.
3.8 Infoweb.ee has the right to give notice to the User via e-mail of new contacts that match the conditions indicated in the User’s agreement.
3.9 Infoweb.ee has the right to transfer the database, incl. personal data of the User contained therein, to a server that is located in a foreign country. In such case, Infoweb.ee shall still remain the responsible processor of the data.
3.10 Infoweb.ee has the right to change the procedures and the menu structure of the
database
without giving an advance warning to the User.
3.11 Infoweb.ee has the right to change these conditions unilaterally, by notifying the
other party
of the changes and by making the new conditions available at the webpages www.infoweb.ee at least 5 days
before the
changes enter into force. The changes shall not have retroactive effect on the services that the User
had ordered
before the changes entered into force.
4 RESPONSIBILITY OF CONTRACTUAL PARTIES
4.1 Infoweb.ee has the right to cancel the provision of services unilaterally and without prior notification or without returning to the User the fee paid for the services, if the User has violated these conditions and has not eliminated the violation within 10 workdays as of the receipt of a respective notice from Infoweb.ee by e-mail.
4.2 The User has the right to give up further use of services at any time and with any reason, by notifying Infoweb.ee thereof by e-mail. In such a case, the User does not have the right to request the return of the fee paid for the ordered service
4.3 The User is responsible for the damages caused to Infoweb.ee through the violation of these conditions.
4.4 Infoweb.ee is not responsible for the accuracy and content of the information entered into the database nor for the damages to the User, arising from the use of the information contained in the database.
5 FINAL PROVISIONS
5.1 In case these conditions prescribe that Infoweb.ee be notified by e-mail, the User shall send such notifications to the e-mail address teenindus@infoweb.ee.
5.2 The parties to the contract shall try to resolve all disputes and differences of opinion arising in the course of fulfilling their obligations through negotiations. In case agreement is not reached, the dispute shall be resolved in Court pursuant to the legislation of the Republics of Estonia.
